Terms of Service
AI assistance requires independent professional judgment.

All responses obtained from AI providers must be reviewed and independently verified by the responsible engineer before they are relied upon. You must also review the information to be transmitted and ensure that you are authorized to share it.
1. Acceptance and scope
These Terms of Service ("Terms") govern your use of the TMAI application and its plugins (the "Service"), provided by TMAI ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, you must not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to accept these Terms on its behalf.
2. Role of the Service
TMAI provides software plugins that prepare data locally and facilitate its transmission from your machine to the AI provider you select. In relation to AI generation, our role is limited to facilitating this exchange. TMAI does not provide engineering services or certify, approve, or independently validate AI responses.
As described in our Privacy Policy, application data remains on your machine except for information sent to your chosen AI provider. Such information does not pass through or get stored on TMAI servers.
3. Independent AI providers
Third-party AI services, including OpenAI (ChatGPT), Anthropic (Claude), and Google (Gemini), are operated by their respective providers. TMAI does not own, operate, manage, or control those providers, their models, or their services. Availability of a plugin does not constitute an endorsement or guarantee of a provider's services or responses.
Your use of a provider is subject to its applicable terms, privacy policies, account requirements, and charges. Each provider is responsible for operating its service and handling data it receives under those terms and applicable law. TMAI does not control the provider's processing, retention, security, or use of that data.
4. Mandatory engineering review of AI responses
AI responses may contain errors, omissions, fabricated information, incorrect calculations, or outdated references, even when presented confidently. No response is warranted to be accurate, complete, compliant with applicable requirements, or suitable for a particular project.
You must ensure that every AI response is analyzed and independently verified by the engineer responsible for the work, with appropriate qualifications and licensure where required, before it is adopted, communicated as a professional conclusion, or used in a design, calculation, specification, report, or construction decision.
Verification must include, as applicable, the source data, assumptions, units, calculations, cited references, project conditions, and applicable codes and standards. AI responses must not be the sole basis for engineering or safety-critical decisions. Use of the Service does not replace professional judgment, required checks, or statutory duties.
The responsible engineer retains responsibility for professional decisions, approvals, and deliverables incorporating AI responses. If a response cannot be independently substantiated, it must not be relied upon.
5. Review and authorization of transmitted data
Before initiating or authorizing a transmission, you must review the information to be sent, including prompts, extracted model data, attachments, and any context supplied by the plugin. The responsible engineer must verify that the information is accurate, relevant, and appropriate for disclosure to the selected provider.
You are responsible for obtaining all necessary rights, permissions, and consents and for complying with confidentiality obligations, client agreements, organizational policies, and applicable data protection requirements. Do not transmit personal, confidential, proprietary, or restricted information unless you are authorized to do so and the provider's terms and settings permit the intended use.
6. Permitted use and security
You may use the Service only in accordance with applicable law, these Terms, and any applicable software license. You must not use it to infringe the rights of others, obtain unauthorized access, or circumvent security controls. You are responsible for protecting your device, provider accounts, access credentials, and local backups.
7. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available," without warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or the accuracy or suitability of third-party AI responses.
To the maximum extent permitted by applicable law, TMAI shall not be liable for losses arising from errors or omissions in third-party AI responses, your reliance on unverified responses, unauthorized disclosures you initiate, or the independent acts or omissions of AI providers. To that same extent, TMAI excludes liability for indirect, incidental, special, or consequential losses, including loss of profits or business interruption.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or waives any mandatory rights or remedies available to you under applicable law.
